Please read the following terms and conditions closely. When you ("You") use Swell IT Studios apps, you acknowledge that you have read, understood and agree to be bound by these terms.
This Terms of Service, and all supplemental terms as amended from time to time, governs your use of the Swell IT apps (the "Swell IT Apps") offered by Swell IT LLC or any of its subsidiaries and affiliates (collectively, the "Services", and each individually, a "Service").
When you or your children use any of the Services, you agree to be bound by these Terms of Service and agree to be considered a "User." As a consequence, this Terms of Service constitutes a legally binding agreement between the User and Swell IT LLC regarding the subject matter herein.
The Services are also bound by all notices, rules, instructions and policies posted by Swell IT LLC from time to time (the "Additional Terms"). The Additional Terms and Swell IT LLC's Privacy Policy are an integral part of this Terms of Service and are incorporated into this document by reference.
Swell IT LLC may modify this Terms of Service at any time. Revisions will be posted on this page. Continued use of the Services after such notice will be deemed acceptance of the changes, so we encourage you to review this page periodically.
The User may be required to provide Swell IT LLC, as a condition of using the Services, certain personally identifiable information ("Personal Information"). Swell IT LLC's retention and use of all Personal Information is subject to our Privacy Policy, as it may be updated from time to time.
The User acknowledges and agrees that the Privacy Policy — including how Swell IT LLC collects, uses and discloses personally identifiable information — is incorporated into and forms part of this Terms of Service. If the User does not agree with the Privacy Policy, the User should not use the Services or submit personally identifiable information through them.
The Service contains a variety of content, including without limitation: software, technology, text, games, information, videos, photos, pictures, graphics, music, sounds, data, illustrations, documentation and other material that users can view on, access through, or contribute to the Service; trademarks, logos, trade names and service marks of Swell IT LLC; and other forms of intellectual property (collectively, "Content").
The Content is owned, controlled or licensed by Swell IT LLC and is protected by law from unauthorized use. The User may not remove copyright or other proprietary rights notices from the Content, and does not acquire any ownership rights over the Content by using the Services or downloading material from Swell IT Studios apps.
Swell IT LLC may, now or in the future, offer the User the opportunity to create, post, upload or otherwise make available content through the Service ("User Submissions"). The User acknowledges that Swell IT LLC does not guarantee confidentiality with respect to any User Submissions. The User remains the owner of any intellectual property rights in their User Submissions, and grants Swell IT LLC a royalty-free, worldwide, non-exclusive license to use, reproduce, distribute and display such User Submissions in connection with operating and promoting the Service.
The User will not use, without Swell IT LLC's prior written consent, the names, characters, artwork, designs, trade names, copyrighted materials, trademarks or service marks of Swell IT LLC in any advertising, publicity, marketing or promotion, or in any manner other than as permitted by this Terms of Service.
All feedback, suggestions and ideas submitted by the User in connection with the Services ("Feedback") become the property of Swell IT LLC, which may use them without restriction or compensation to the User, unless prohibited by law.
Some Services may require you to open an account by providing current, complete and accurate information. You are responsible for maintaining the confidentiality of your password and account and for all activity that occurs under it. Notify us immediately at info@swellitglobal.com of any unauthorized use or security breach. You may not use anyone else's account at any time.
Swell IT LLC has the right to terminate or suspend, and you have the right to cancel, your account or a particular subscription at any time, following the procedures made available with the applicable Service. In the event an account is terminated, suspended or canceled, no refund will be granted for amounts already incurred, and the User will lose access to the account and anything associated with it.
Some Services require payment of fees (the "Fees"). Unless otherwise indicated, all prices are in US Dollars and do not include internet service provider, telephone or other connection charges. Swell IT LLC reserves the right to change its fees or billing methods at any time, and may use third-party providers to collect or process Fees. The User is responsible for all fees and charges incurred by anyone using their account, including family or friends, unless the account was obtained unlawfully or fraudulently by someone unauthorized.
As a condition of your use of and access to the Service, the User agrees to comply with these rules of conduct, provided as examples rather than an exhaustive list, along with any application-specific rules published within the Services. The User agrees not to use the Services to:
